Snohomish County reduces fines so Monroe shooting range owner can get permit

EVERETT — Fines that a Monroe man owes Snohomish County over an illegal berm at a private shooting range have been cut drastically under a revised decision from the county hearing examiner.

The new penalty against Jim Faire is $1,500 for the first 20 days, starting Tuesday, according to Hearing Examiner Barbara Dykes’ order. That amount would grow by $4,500 if Faire does not get the proper permits after 20 days, another $6,000 after 40 days and another $7,500 after 60 days.

Noise complaints first drew the county’s attention to Faire’s Ben Howard Road property. Code-enforcement officials fined Faire over the berm and over hosting a commercial gun range in June, but he appealed at a Sept. 17 hearing.

Dykes’ original Oct. 2 order dismissed the commercial shooting range violation, but ruled that Faire owed $6,000 for the berm. That fine would grow by $3,000 daily until he got the permits. Because county permits often take a month or longer, Faire worried he would be forced to pay more than $90,000.

The very code that defines violations proves I did not violate the code but that is what Barbara Dykes is using to charge me with, truly call black white and white black, she has the law backwards.
I challenged this with the motion for reconsideration but she ruled she has no authority to deal with constitutional issues and ruled on Washington Administrative Code outside the jurisdiction of the Snohomish County hearing examiner, WAC only applies to corporations, not individual living souls.

How long has the berm been in place?

The berm has been there since 1968 the Shoreline Management Act was created in 1971 and the county adopted some of the FEMA laws in 1984 and growth management act in the early 1990's.

It takes 32 days just for an appointment to apply for a permit.

I have an appoint for Nov. 9th 2009 for a application, the application costs $5800 .

$5800! and the berm was there before the law was even drafted? Amazing. Is that considered retroactive taxation?

With an elevation of 65 feet above sea level, the notion that Mr. Faire's little berm would have some effect in the event of a tsunami is patently ridiculous. This is about greed and abuse of power, nothing else.
